PURPOSE & ACCEPTANCE

These Terms & Conditions apply to all services offered by Riad Atay. Any confirmed booking implies full and complete acceptance of these Terms & Conditions, acknowledgement of having read them in full, and waiver of any of the guest's own purchasing conditions. These Terms & Conditions prevail over any other general or specific conditions not expressly agreed to by Riad Atay.

RATES & PAYMENT

Our prices are quoted in euros. Tourist and stay taxes are not included in the room rate and are payable exclusively in dirhams, in cash, upon check-out. When booking through our booking engine, you will be asked to provide a valid credit card as a guarantee. The card's validity is verified automatically, but no amount is charged: we take no deposit or prepayment before your stay (except for exclusive rental of the Riad — see the dedicated section below). Payment is made on site at the Riad upon arrival. We accept Visa and Mastercard, as well as cash. A 5% discount on the room rate is offered for any payment in cash (in dirhams or euros). Tourist taxes, consumptions, transfers, transportation and any other extras must be paid exclusively in dirhams and in cash upon check-out.

TOURISTIC TAX

The tourist tax in Morocco is 25 dirhams per person and per day. It is not included in the room rate.

EXCHANGE RATE

Our rates are based on a fixed exchange rate of 1 euro = 10.5 dirhams.

CHECK-IN & CHECK-OUT

Your room is ready to welcome you from 3:00 pm on the day of your arrival. We kindly ask you to vacate it by 12:00 pm (noon) at the latest on the day of your departure. For any request regarding early check-in or late check-out, please let us know in advance: we will do our best to accommodate you, depending on room occupancy. Should these times not fit your travel plans, a luggage service is at your disposal.

CANCELLATION POLICY

For any room booking at Riad Atay, the cancellation policy applies as follows:
- Cancellation 14 days or more before the date of arrival: free cancellation.
- Cancellation 13 days or less before the date of arrival: 100% of the stay is due.

CHILDREN

In order to offer our guests an experience of quiet and relaxation, children under the age of 12 are not admitted to the Riad. We fully understand the wish to travel as a family; however, certain architectural and decorative features may present risks for younger children (open plunge pool, gaps between the upper-floor railings, staircase partly without a handrail). In addition, the close proximity of the rooms does not allow us to guarantee the comfort and tranquility of all our guests. Children aged 12 and over are considered adults and must occupy an available bed. This rule does not apply in the case of exclusive rental of the Riad: in that case, no age limit applies.

FOOD & DRINK

Breakfast is included every morning. Lunch and dinner are prepared on request, from fresh, seasonal produce. In order to preserve the quality and harmony of our service, we kindly ask you not to bring food or drinks from outside. Your meals can be served in our patio or on the Riad's terrace.

SMOKING

Smoking is not permitted in the rooms and suites of the Riad. Smoking is, however, allowed on the terrace.

PETS

For the comfort of all, pets are not admitted at Riad Atay.

EXCLUSIVE RENTAL OF THE RIAD

For the exclusive rental of the Riad (whole Riad), the following specific conditions apply:
- Riad Atay can be rented exclusively for a minimum stay of 2 consecutive nights.
- The booking is confirmed after payment of 50% of the total stay as a deposit, by credit card exclusively; the balance is payable 31 days before arrival.
- Cancellation 61 days or more before the date of arrival: free cancellation.
- Cancellation from 60 to 31 days before the date of arrival: 50% of the stay is due.
- Cancellation 30 days or less before the date of arrival: 100% of the stay is due.
- Exclusive rentals of the Riad covering the year-end holiday period (from 20 December to 4 January inclusive) are non-refundable and non-modifiable.

RIGHT OF WITHDRAWAL

In accordance with Article 38 of Moroccan Law 31-08, the right of withdrawal does not apply to accommodation, catering and leisure services provided on a specified date. The cancellation conditions set out above apply to all our bookings.

MODIFICATION OR CANCELLATION BY THE RIAD

Riad Atay reserves the right to modify or cancel a booking for operational reasons or in the event of force majeure. In such a case, the Riad undertakes to inform the guest as soon as possible and to offer an alternative of equivalent value or to fully refund the amounts already paid. No further compensation shall be due.

ADMISSION TO THE RIAD

We reserve the right of admission at all times, as well as the right to refuse the rental of rooms or access to certain areas of the Riad, for reasons of safety and the well-being of all. The protection of our guests and visitors is our foremost concern.

PROHIBITED USES

In order to offer a safe and serene experience to all our guests, certain activities are not permitted within the Riad, including, but not limited to:
- Any act likely to harm the reputation of the Riad, or any inappropriate conduct.
- Impersonating an employee, agent or representative of the Riad without authorization.
- Carrying out any commercial activity within the Riad without our prior written consent.
- The presence of persons engaged for services of a sexual nature.
- Any discriminatory or intimidating behavior, or any act that undermines the dignity of others.
- Any violation of the privacy of other guests or visitors.
- The commission of acts that are illegal under Moroccan law, including the possession or use of controlled substances or weapons.
- Taking photographs or films intended for public broadcast without our prior written consent.
- Using the Riad's intellectual property (trademarks, trade names) without our written agreement.

RECOMMENDATIONS AND RESPECT FOR LOCAL CUSTOMS

Morocco is a country proud of its heritage and attached to its traditions. We encourage you to show sensitivity by respecting local customs, particularly during the month of Ramadan and when visiting places of worship. As in any destination, we recommend taking the usual precautions to ensure your safety and that of your belongings throughout your stay.

INSURANCE & LIABILITY

We strongly recommend that our guests take out comprehensive travel insurance, covering in particular cancellation, interruption of stay, medical expenses, repatriation, as well as the loss of luggage and personal belongings. Each room is equipped with a safe. The Riad cannot, however, be held responsible for the loss of or damage to personal belongings left in the room or anywhere else in the Riad. We invite you to use the security measures at your disposal and to take all necessary precautions to protect your personal belongings.

EVENTS BEYOND RIAD’S CONTROL

Events beyond the Riad's control include, but are not limited to: war or threat of war, riot or civil unrest, government action, terrorist activity, natural or industrial disaster, fire, adverse weather conditions, earthquake, flood, airport closure, labour dispute, technical failure, or failure of IT infrastructure or internet connections. Unless expressly stated otherwise, the Riad cannot be held liable or offer compensation where the performance of its obligations is prevented or affected by such events.

GOVERNING LAWS & DISPUTES

These Terms & Conditions are governed by Moroccan law. In the event of a dispute, the competent courts shall be those of Marrakech.
